The Indian Gaming Association revealed the plan at its annual meeting in San Diego. The event took place on March 31, 2026, with tribal leaders in attendance. The fund may raise between $3 million and $5 million. Its goal is simple — take action against the Commodity Futures Trading Commission.

The issue centers on prediction markets. These markets offer contracts tied to real events, such as sports results. Tribal leaders say these contracts look like sports betting — but avoid key rules. That gap has raised concern across the industry.

Call for Clear Rules and Fair Play

IGA Chairman David Z. Bean spoke about the plan during the meeting. He said the group will follow two paths at once. First, it will file a lawsuit. Second, it will ask Congress to clarify the law.

He warned that these markets may bypass tribal authority — and shift control away from local rules. That message shows rising concern among tribal operators.

Main Concerns From Tribal Groups

Tribal leaders point to several problem areas:

  • Different rules for licenses

  • Weaker age checks for users

  • Lower levels of player protection

The planned case may claim the regulator failed to enforce its own rules. It may also point to federal laws tied to online betting. These include the Wire Act and the Unlawful Internet Gambling Enforcement Act. Both laws help define what is allowed.

At the same time, legal action has started in several states. Tribal groups have filed cases against Kalshi in key regions. In Nevada, a court issued an order — blocking some contracts for now. Other states, like Arizona and Wisconsin, have taken similar steps.

High Stakes for the Industry

Tribal gaming plays a large role in the U.S. economy. It generated $43.9 billion in revenue during 2024. This money supports health care, education, and public works. Leaders say weak oversight could harm that system over time.

Beyond the courts, the IGA is working with national groups and state officials. They hope to build support in Washington. Nevertheless, change in Congress may take time — and may face delays. The result could shape how these markets work — and who controls them.
